Based on Article. 47 par. 1 of the Act on the Protection of Personal Data, the transfer of personal data to a third country may take place if the country of destination provides on its territory an adequate level of protection of personal data.

It should be noted that the quoted provision reflects the content of art. 25 ust. 1 of Directive 95/46 / EC, according to which Member States shall ensure that the transfer to third country of personal data being processed or intended for processing after their transfer may take place only if - regardless of compliance with national provisions adopted under other provisions of this Directives - the third country concerned will ensure an adequate level of protection.

In the light of the provisions of the Act on the Protection of Personal Data and European Law, transfer of personal data to a third country is, in principle, possible only if the state provides an adequate level of protection of personal data.
